ABOUT THIS PLATFORM
This gallery (the "Platform") is operated by Jan Virt, a photographer and filmmaker based in Paris, France ("Jan Virt", "We", "Us", or "Our"). The Platform is a self-service media gallery allowing press, media professionals, journalists and business partners ("You", "User") to access, view and use high-quality photo and video content.
SCOPE
These terms ("Terms") apply to all content made available through the Platform, including photographs, video footage, audio, captions, and associated metadata (collectively "Content"), as well as any tools or services provided. By accessing or downloading any Content, You agree to be bound by these Terms.
CHANGES TO THESE TERMS
We may update these Terms from time to time. We will notify You of significant changes. Continued use of the Platform following notification constitutes acceptance. If You object to any changes, You may terminate Your account by contacting us in writing.
SECTION 02
Access & Registration
To download Content, You must register an account. Registration is open to persons aged 18 and over who provide accurate and complete information. We reserve the right to decline registrations at our sole discretion. You may hold only one account.
ACCOUNT SECURITY
Your login credentials are for personal use only. You must not share them with third parties. Notify us immediately at info@janvirt.com if You suspect any unauthorised use of Your account.
SECTION 03
Intellectual Property
All Content on this Platform — including photographs, video, text, and associated metadata — is protected by copyright and related rights. All intellectual property rights remain the property of Jan Virt or the relevant rights holders. No rights are granted beyond those expressly stated in these Terms. You may not reproduce, republish, transfer or exploit any Content without prior written authorisation.

Your Rights & Permitted Uses
Content is made available under three categories. Please check the label on each asset before use.
NEWS USE
NEWS COVERAGE
Content may be used for reporting and coverage of current events. You may edit, publish and broadcast as needed for news purposes.
License period: 7 days from the date of the event.
EDITORIAL USE
EDITORIAL COVERAGE
Content may be used for editorial reporting on current or past events. Publication on all media channels is permitted.
License period: 6 months from your download date.
LICENSED USE
PAID LICENSE
Some Content is available for licensing against a fee. Contact us to discuss terms before any commercial use.

NEWS USE — PERMITTED IN DETAIL
Broadcast via free TV, web TV, IPTV, and mobile TV
Streaming and on-demand publication on news channels (excluding YouTube)
Editing and technical format adaptation for news coverage purposes
Promotional clips up to 30 seconds in direct relation to the Content
Unlimited print publication and written or pictorial quotes
EDITORIAL USE — PERMITTED IN DETAIL
All broadcast and streaming rights as for News Use, including YouTube (shortened versions only — max 70% of original duration)
Editing and adaptation for Your specific editorial communication purpose
Promotional clips up to 30 seconds
Unlimited print publication and written or pictorial quotes
Credit © Jan Virt must be visible at all times on Editorial Content published online
SECTION 05
Excluded & Prohibited Uses
The following uses are not permitted under any circumstances, unless separately agreed in writing:
No advertising use. Content may not be used for commercial campaigns, advertising, endorsement or promotional materials.
No long-format productions. Content may not represent more than 30% of any editorial programme, or be used in commercial productions exceeding 12 minutes in length.
No music rights. Music rights are not included. You are responsible for clearing all sync, master use, and performing rights separately.
No redistribution. You may not sell, sublicense, or distribute Content to third parties in exchange for payment.
No unlawful use. Content must not be used in connection with illegal products, content, catastrophe or accident coverage that could be damaging to reputation, or competing products.
No re-publication. You may not republish or mirror the Platform or its Content on other websites or media platforms without written permission.

SOCIAL MEDIA
Tag the appropriate account when sharing Content on social media platforms. For photos, please also credit the photographer where applicable.

SECTION 07
Disclaimer & Liability
Content is provided on an "as is" and "as available" basis. We make no warranty as to the accuracy, completeness, or fitness for purpose of any Content. You access and use the Platform at your own risk.
We are not liable for any direct, indirect or consequential damages arising from Your use of the Platform or its Content, including but not limited to service interruptions, errors, or delivery delays, except where liability cannot be excluded under applicable French law.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, or for fraudulent misrepresentation.
SECTION 08
Termination
You may cancel Your account at any time by emailing info@janvirt.com. We reserve the right to suspend or terminate access if these Terms are breached, without prior notice.
SECTION 09
General Provisions
ASSIGNMENT
Your rights under these Terms are personal and may not be transferred or assigned without our written consent.
SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
GOVERNING LAW & JURISDICTION
These Terms are governed by French law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Paris, France.
LANGUAGE
These Terms are written in English. In the event of any inconsistency with a translated version, the English text shall prevail.
